Land claims, a problem lasted for decades and cause frustration for the people when government use force to seize people's land without making compensation or inadequate compensation that profiteering for themselves without having to know the great difficulties that people have to suffer after the land coercive action is unlawful and immoral.. .. And then gunshots in Tien Lang district that has been truly awakened the leaders of governments at all levels and alarm the potential risks that can lead to social unrest before corruption spread and serious moral degradation from the communist party members who currently have and are holding important positions in the apparatus of government and leaders of the country.


Plausible conclusion of Prime Minister Nguyen Tan Dung has recently partly help people regain some trust with justice and law. But hope is not perfect it was like a candle flares up and then suddenly finish when a military court yesterday sentenced 09-03-2012 was heavy for 5 people of ethnic minorities Nung both Shandong and Luc Ngan district of Bac Giang province in the scuffle with the authorities to protect their legitimate interests related coercive land in August 2011. Above actions of the state government of Vietnam as a slap in the face of people that take away all hope and faith in the heart of the burgeoning civil law and government. Now everyone in the emergence of a large question mark over whether the government after the Tien Lang really awake and in good faith to correct or not?


Above actions of the communist government of Vietnam as added fuel to the fire and becomes a new challenge for petitioners in whole country. Could it be great benefits from the land has actually obscured the conscience of the leaders and governments at all levels? and then where will the situation as well as the fate of farmers go when the authorities have taken action to continue to disregard the law and cynical people when the government crackdown on people and then condemn the actions of defense themselves while the wrong actions of administration that is the main cause leading to conflicts but was not interested and not be punished as prescribed by law.

A military court has sentenced five people in Bac Giang province on charges of disturbing public order on March 9 last.

On the morning of March 9, the Military court of military region 1, second area were open trial of five people of Van Phong commune, Luc Ngan district, Bac Giang province on charges of disturbing public order. Those who were sentenced from 42 months to 54 months in prison.

No defense attorney

On March 8 last, Army Military District Court conducted a trial and six others Kim Son commune, Luc Ngan district with similar offenses. The sentence from 12 to 48 months in prison. Reply RFA freedom after the hearing on March 9, an unnamed local people said:

"Today, treatment 5 people at  Vung Phi village, Van Phong commune, yesterday treated six people at Kim Son. I watched the trial today. Be outside for listening from speakers, not directly see them. "

People do know how to defend. People only know for a reduced sentence but only to defend what you know nothing.

The persons were sentenced who among 19 ethnic Nung  people of both Son Dong and Luc Ngan District in Bac Giang province, had been captured from the government in August 2011 after a clash over a thousand people local police and soldiers, related to land disputes between citizens and government.

A resident monitor both the progress of the trial said the defendant has no attorney, and the people themselves do not understand the procedures for defense:

"People do know how to defend. People only know for a reduced sentence but only to defend what you know nothing. "

A relative of a defendant for Radio Free Asia said his family is not happy with the results of the trial, although admitting that some people have burning uncontrolled actions:

"There are many issues you do not like. The first is ethnic in its remote areas have no knowledge of law, not applied as an extenuating circumstance, while the second is to require the general regime, not what your headed , the people of the compensation shall not be fair, some people burning. At the people there is a radical, people are losing control should be pressing the scuffle, and are not aware of his behavior. "

On August 11, 2011, approximately 1,000 mobile police, civil defense and the army was mobilized to the land of the enforcement people in Kim Son commune, Phong Minh and Phong Van of Luc Ngan district, Bac Giang caused major clashes with more than 1,000 people here. These people used bottles, stones, sticks and knives against the coercive force.

The source of the work started in 2003 when local authorities decided to remove about 2,300 households in two districts of Son Dong and Luc Ngan to make the national fire TB01. The first farmers began to move in 2003. Then other households displaced during the 2005 to 2006. The displaced people, are promises to pay compensation for land and crops, but many people are not satisfactory compensation and social inequity between different, even between the Kinh and the Nung. Unidentified people, said:

The public discontent

Since 2007 residents of Luc Ngan and Son began to look to government inspection agencies to complaints of inadequate compensation. By October 27, 2010, Deputy Prime Minister Nguyen Sinh Hung decided to assign the Ministry of Natural Resources, in conjunction with the Ministry of Finance and Ministry of Defense recommendations for consideration and handling of people, and commissioned the Northern Province Jiang must report before November 15, 2010. By January 6, 2011, Mr. Nguyen Sinh Hung has written request of Bac Giang province have decided to comply with signed December 6, 2004 by Deputy Prime Minister about the level of compensation for civil defense and traffic associated settlement. However, until April 2011 people still do not get definitive answers from local authorities about compensation as decided by the government.

The people displaced after many months had lost their livelihood, fell into complete poverty. Meanwhile, their claims on the central government in several years is still not resolved. So around mid April 2011, hundreds of people from Kim Son commune, Phong City, and interviews were automatically returned to their former lands to try farming. These people broke the shack of soldiers and kicked off the force of their land. A resident said that people's actions are not illegal land occupied because there is no way to live:

"Went demanding regime, has sent letters for years and which are not very specific answers. People go where not many complaints are superior answer.

This pressing people too, the poor, the difficulties that can not be answered definitively so, back to farming, which requires ever mode state response and compensation on land, but never have intend to occupy land illegally or against. "

These people stayed in farming since the April 2011 month until August 11, 2011 shall be forced out from the area.

The land for enforcement is occurring on a lot in Vietnam, causing discontent among the people. In some cases, clashes occurred between the coercive force and people, similar cases of people in Bac Giang.
